RENTAL POLICY AND AGREEMENT

By signing the rental policy and agreement form, I agree that I have read, fully understand and agree to all the below policies and to hold harmless from any responsibility or liability, Cozy Cove Cabin Rentals, LLC cabin owners and their representatives resulting from any loss, damage or personal injury incurred by any Guest on the rental cabin premise.

This agreement constitutes a contract between the Guest(s) and Cozy Cove Cabin Rentals, LLC (CCCR)

CCCR serves as the agent and representative of all owners of rental cabins in our rental program, and is acting at all times, in and for the best interests of the owners.

CHECK-IN TIME is 3 PM at the rental cabin. CCCR will use all reasonable efforts to have the cabin ready for guest occupancy at check-in time, but CCCR cannot guarantee the exact time of occupancy. Please call our office 1-2 days prior to arrival for the code to the cabin's key lock box.

* Please note - NO ARRIVALS allowed on THANKSGIVING DAY, CHRISTMAS DAY(Dec.25) , NEW YEARS DAY (Jan 1).

* We are not a resort and DO NOT offer 24-hour services! You MUST check in by 5:00PM, before our office closes.

* We can not guarantee the DVDs, TVs, or VCRs

CHECKOUT TIME is prior to 11 AM. Please be prompt as to allow us to have adequate time to prepare the cabin for the next guests and return all keys to the cabin's key lock box before leaving to avoid additional charges.

RESERVATION REQUIREMENTS – Reservations made less than 30 days in advance or less than $300.00 total charges will be charged the entire amount up front. For those reservations 30 days or more in advance, a 50% deposit must be paid and we must receive a signed RESERVATION AGREEMENT to secure a reservation. Guests may print this agreement, complete and fax to CCCR at 706-781-3240 or email us at cozycovecabinrentals@windstream.net. Cozy Cove Cabin Rentals, LLC accepts MasterCard or Visa. Balance of rental fee is due prior to arrival with MasterCard or Visa. In addition, as soon after arrival as possible, guests must come to Cozy Cove Cabin Rentals, LLC office to sign a $250 security deposit and pick up your receipt. This security deposit will be voided after housekeeping determines that no damage has been done to the rental cabin. In the event damage is found at the rental cabin, the entire security deposit may be retained by Cozy Cove Cabin Rentals, LLC. (CCCR Directions are printed at the end of this document.)

PAYMENT - If your reservations are made and it is more than 30 days to check in, half of the total amount will be charged to your Credit Card on the day the reservations were made and the other half will be charged on the first day of the month you will be checking in. Renters have to be paid in full before check in date. If you make reservations and we charge the total amount or half the amount to your card and you request that we remove those charges and put them on another Credit Card, there will be a $30 administrative fee.

CANCELLATION – A $30 administration fee is assessed for all cancellations. However, if Guest(s) cancel less than thirty (30) days prior to the arrival date there will be NO REFUND. For a refund of deposit (less a $30 administration fee), cancellations must be in writing and received by Cozy Cove Cabin Rentals, LLC at least 30 days prior to arrival date.

NO-SHOW POLICY – The total amount of the reservation will be charged along with a $30 administration fee.

CONFIRMATION – Confirmation of the reservations will be mailed, faxed or e-mailed to Guest(s) upon receipt of the reservation advanced payment and a signed reservation agreement form. Please read the confirmation for accuracy of cabin name, dates, charges, your name and mailing address, phone number, email address, number of adults, children and pets (where pets are allowed only). Report any errors to CCCR immediately upon receipt of confirmation. Pay close attention to the number of persons on the confirmation. Occupancy is limited to REGISTERED GUESTS ONLY. Absolutely no overnight visitors are allowed without prior arrangements made in advance in writing to CCCR.

ADDITIONAL GUESTS (More than the reservation agreement state) – Additional guests, over the age of 5, must be pre-approved by CCCR and there will be a charge of $10 per person, per night. There is no charge for children age 5 and under.

KEYS – All keys must be returned to the cabin key lock box upon Checkout. Our rental cabins are privately owned and Guests are responsible for lost keys. The property must be re-keyed in the event the keys are lost, misplaced or not returned and you will be responsible for the cost of this procedure.

SATELLITE OR CABLE TELEVISION – All cabins are privately owned and have different subscription packages for satellite or cable TV. CCCR does not guarantee any programs or events.

TELEPHONE CALLS – Some cabins are equipped with a telephone. All long distance calls are to be placed by credit card, or calling card.

SMOKING – Smoking is not permitted inside any cabin. Outside smoking is permitted but please do not litter.

WE DO NOT PROVIDE FIREWOOD FOR CABINS!

ALCOHOLIC BEVERAGE – By Georgia Law, no drinking of alcoholic beverages by persons under the legal age of 21 is allowed.

BUGS & BEES - There is going to be bugs & bees because this is the mountains. Bring some spray!

PETS – Some cabins allow pets so please contact us prior to reserving a cabin if you would like to bring your pet with you. The pet fee is $10 per night per pet. Pets are to be housed in a crate inside of the cabin when Guests are away from cabin. There is an additional pet deposit of $150, which will be treated the same as the cabin rental damage deposit. If you have a pet and it is not listed on the reservation agreement, your immediate eviction and loss of all rents and security deposit will result. Prior permission must be granted. Pets are not allowed on furniture or bedding.

CABIN FURNISHINGS & EQUIPMENT – All cabins are privately owned with furnishings and equipment provided by the cabin owner. CCCR cannot make any changes to this. Moving of furniture is prohibited. If you require special appliances or equipment, please bring them with you. Décor, style, color and themes will vary between cabins. Furnishings are subject to change without notice.

LINENS – All cabins are supplied with bed linens, towels, blankets and pillows. These items are not changed during your stay. CCCR provides your initial supply of paper products, hand and dish soaps, and trash bags, for your convenience.

CABIN DESCRIPTIONS AND RATES – Information regarding the individual cabins is believed to be accurate but cannot be guaranteed. We have made every effort to ensure that all the information on CCCR’s Web-site is current and accurate. The possibility of errors and omissions still exists. We will be happy to confirm all the rates; however, furnishings, fees and taxes are subject to change without notice. Rates for weekly stays are found on our Web-site at www.cozycovecabinrentals.com. Rates for holidays, special events and weekends may be slightly higher. Rates do not include tax or end-of-stay cleaning fee. Most of our properties can be rented for a two-night minimum stay. A minimum stay of three nights may apply during holidays & specific times of the year.

TAXES AND FEES – For pets, a pet fee of $10 per night per pet plus $150 refundable damage deposit is charged. An end-of-stay cleaning fee of $60 required for all rentals. Applicable taxes are 7% state tax and 5% county tax on all rentals.

CHECKOUT PROCEDURES – We ask that you please comply with the following items prior to checkout:

Property should be left in the same condition it was when you arrived.
All litter, cigarette butts and pet waste should be picked up from the yard and placed into trash bags.

All bagged trash put in the outside garbage cans.
Lock all windows and doors, set A/C to 78 or heat on 55 degrees, depending on season.
Wash, dry and put away all dishes, pots, pans and kitchen utensils (do not leave in dishwasher).

REPAIRS – SERVICE CALLS – CCCR cannot guarantee against mechanical failure of heating, air conditioning, hot tubs, TV’s, satellite receivers, VCR/DVD players or other appliances. Please report any equipment that is not operating properly. CCCR will make every effort to resolve the problem as quickly as possible. Should a repair person make a call to a cabin and find the equipment in working order and the problem was due to Guest(s) oversight or neglect, the charge for the service would be the Guest(s) responsibility. All maintenance repairs must be reported to CCCR between 9 AM and 5 PM. Guest(s) understand and agree that CCCR or its repair people might need access to the cabin for the purpose of making the repair.

REFUNDS – or rate adjustments are not made for any inconvenience due to construction noise, road repairs, early departures, delayed arrivals or reducing the number of nights reserved with less than 30 days notice. No refunds or reschedules due to inclement weather.

TERMINATIONS BY OWNER/SUBSTITUTIONS – CCCR strives to comply with your reservation request, however due to uncontrollable circumstance, i.e. changes in ownership, properties being removed from the rental program, mechanical problems, etc. We cannot absolutely guarantee a specific cabin. CCCR reserves the right to change your cabin without notice or liability should the cabin become unavailable. Neither the owner nor CCCR shall be liable for events beyond their control, which may interfere with your visit. This may include, but is not limited to Acts of God, Acts of Government Agencies, fire, war, inclement weather and construction noise. No rebate or refund will be offered in these circumstances. If a cabin you have reserved becomes unavailable, we will try to offer a comparable cabin at the same rate, satisfactory to you, or you may receive a refund of your deposit less a $30 administrative fee. CCCR will try to give you as much notice as possible so other arrangements can be made.

HOUSE PARTIES ARE NOT ALLOWED – Rental Guest(s) understand that CCCR will accept responsible adults over the age of 21 only. Guest(s) agree that no more than the number of persons listed on the reservation agreement shall occupy the premise overnight. If more than the number of persons occupies the unit stated, the result will be a loss of total rent, security deposit and / or additional charge to your credit card. Guests shall not disturb or offend any neighbors, discharge firearms or use fireworks of any kind in accordance with State of Georgia and Union County laws.

COZY COVE CABIN RENTALS reserves the right to refuse service to anyone. All rental cabins are leased without regard to race, color, religion, sex, national origin or handicap.

CREDIT CARD – I, the Guest, am providing my credit card number as a guarantee. I agree to pay all rent and damage deposits, accept all terms of this reservation agreement and accept all liability for any damage beyond normal wear and tear during the term of my lease with Cozy Cove Cabin Rentals. If I fail to do so, I understand that these costs will be charged to my credit card and all credit card sales are final.

HOT TUBS - Guest may not add any objects or chemical to the hot tubs. Guest agree to pay no less than $100, if hot tub has been compromised in such a manner that results in cleaning services being delayed. Hot Tubs have been cleaned prior to guest arrival. Guest agree to pay an additional $35 if guest request an additional cleaning of hot tub during guests' stay. Guests understand that hot tub usage is at their OWN RISK and WILL NOT hold agent or Property Owner responsible for ANY injury. It is absolutely forbidden for children to be in the hot tub without a responsible adult.

ROADS - Roads leading to the rental properties can sometimes be dirt and gravel and mountainous and are sometimes bumpy. Agents are not responsible for conditions of the road NO REFUND OR REBATE will be offered.

BEAR-DEER-INSECTS - Guest are in the mountains and woods and depending upon the time of year may encounter Bear, Deer, Turkey, Ladybugs, Carpenter Bees, Wasps, Scorpions, Ticks, Ants, Chiggers, ect. Guest are encouraged to dress accordingly and to bring insect repellant for outdoor activities. NO REFUND OR REBATE will be offered.

LOCKOUT - Lock out of guest from cabin will result in a $25 service call during business hours. Guest agree that a lock out after business hours will result in a locksmith being called and guest credit card being charged accordingly.

KEY RETURN - Guest are responsible for returning the key back in the lock box of the rental property.
The key is to be placed back in the lock box and the door locked upon check-out, guest agree that the Agents are authorized to charge the credit card on file for the cost of the re-keying or replacing all of the locks and re-issuing new keys to the owners, cleaning crews and Agents.

PET POLICY - Guest acknowledge, understand, and agree that for Agents to continue it's very lenient Pet Policy, the following items must be adhered to:

* Pets are not permitted in hot tub. Guest agree to pay not less that $100 cleaning fee if pets get into the hot tub.

* Pets must be completely housebroken, well behaved and pest free.

* Pets are NOT allowed on furniture or bedding. Guest will be charged a cleaning fee of not less that $50 if pet hair causes a delay in cleaning services.

* Guest agree that they will not use any linens or towels on pets other than the pet towels brought by guests.

* Pets shall Not be left uncrated while alone in cabin.

* Guest agree to pay any damage caused by pets.

* If the pets have an accident in the cabin, clean up will be performed by the guests. Guests further agree to police waste from the grounds and deposit in outside garbage cans. Guests agree that failure to comply with clean-ups of either inside or outside cabin will result in an additional cleaning charge of not less than $50.

* If any of these pet policy items are not met, Guest are in violation of this Agreement/Contract. Guest agree that by signing this Agreement/Contract, they are authorizing Agents to charge Guest credit card on file for any damages sustained.

FIREPLACES & FIRE-PITS - All fireplaces are seasonal and are operational from October 1st--April 1st. Nothing shall be burned in gas log units and nothing other than hardwood or duraflame type logs shall be burned in wood burning fireplaces. If the the property does not offer a firepit guest will not make one, doing so is considered damage a guests will be charged accordingly. Guest agrees that no burning or smoldering fireplaces or firepits shall be left by guest, ever. There is to be absolutely NO cooking of any food over the fireplaces or firepits. Firewood is not provided for wood burning fireplaces.

SECURITY DEPOSIT - There will be a $250 damage deposit held on the guests credit card to cover any unintentional damage up to $250. The deposit does NOT cover any intentional damage, theft, excessive cleaning or any flea infestation caused by pets. The deposit will be held until the cleaning crew goes to inspect the rental property to insure no damage was done during the guests stay. Damage over the amount of $250 will also be charged to the guests credit card.

ITEMS LEFT BEHIND - CCCR is not responsible for any items guests leaves behind in the cabin. Agents are authorized to charge a fee of $25 plus shipping costs for the return of any items guests leave behind in the cabin.

DOUBLE BOOKINGS - Double bookings are very rare but the possibility of errors exist. In the event that Guest(s) reservation for the rental property overlaps or mat reservation of another tenant, Agent(s) reserves the right to relocate Guest(s) to different property within the agents rental company. Every effort will be made to insure that the replacement property is reasonably comparable to the original property booked depending on how many properties are booked at the time. Guest(s) will have the option (1) accept the replacement property or (2) reject the replacement property and receive a refund all rent and fees paid for the rental property. Guest(s) agree that Guest(s) choice between these alternatives will be the Guest(s) sole responsibility of any and all damages, liability, or inconvenience arising out of the double booking.

VIOLATING AGREEMENT - If Guest(s) violates any of this Agreement; Agents(s) may terminate this Agreement on Premises. Upon notice of termination of this Agreement, Guest(s) shall vacate the premises immediately and forfeit all rents and security deposits.

Take 515 through Blue Ridge and past the 515/Hwy 60 intersection. Go approximately 2 miles further to the intersection of 515 and Loving Road. Take Hwy 19/129 north into Blairsville, GA. Follow 19/129 through the Blairsville town square until you get to 515.
